Terrorist states are seeking nuclear weapons without delay; he wants to meet them without preconditions. Al Qaeda terrorists still plot to inflict catastrophic harm on America, and he's worried that someone won't read them their rights. '' – Gov. Sarah Palin, September 3, 2008
In an apparent policy shift in the war against "man caused disasters", the Obama administration has sent FBI agents to Afghanistan to read Miranda rights to captiured illegal enemy combatants.
When 9/11 mastermind Khalid Sheikh Mohammad was captured on March 1, 2003, he was not cooperative. “I’ll talk to you guys after I get to New York and see my lawyer,” he said, according to former CIA Director George Tenet.
Of course, KSM did not get a lawyer until months later, after his interrogation was completed, and Tenet says that the information the CIA obtained from him disrupted plots and saved lives. “I believe none of these successes would have happened if we had had to treat KSM like a white-collar criminal – read him his Miranda rights and get him a lawyer who surely would have insisted that his client simply shut up,” Tenet wrote in his memoirs.
If Tenet is right, it’s a good thing KSM was captured before Barack Obama became president. For, the Obama Justice Department has quietly ordered FBI agents to read Miranda rights to high value detainees captured and held at U.S. detention facilities in Afghanistan, according a senior Republican on the House Intelligence Committee. “The administration has decided to change the focus to law enforcement. Here’s the problem. You have foreign fighters who are targeting US troops today – foreign fighters who go to another country to kill Americans. We capture them…and they’re reading them their rights – Mirandizing these foreign fighters,” says Representative Mike Rogers, who recently met with military, intelligence and law enforcement officials on a fact-finding trip to Afghanistan.
Rogers, a former FBI special agent and U.S. Army officer, says the Obama administration has not briefed Congress on the new policy. “I was a little surprised to find it taking place when I showed up because we hadn’t been briefed on it, I didn’t know about it. We’re still trying to get to the bottom of it, but it is clearly a part of this new global justice initiative.”
This sounds eerily familiar to the Bill Clinton approach to terrorism.
Terrorism analyst Neil Livingstone called the move a "dramatic shift" in policy.
"(We're) going back to the bad old days that gave rise to 9/11 when we treated terrorism as though it were a criminal problem, not as a war or not as an attack on the United States," he said. "We don't want to have to make a legal determination every time we go after a terrorist whether we've got a good case or not, we should go after them as enemy combatants of the United States."
Some lawmakers are increasingly concerned the administration is moving too far away from what was once called the Global War on Terror.
As one milblogger at Blackfive noted,
Our enemies are laughing at us because at every turn, our Commander in Chief continues to show what huge pussy he is who is overly defensive and supremely concerned with the feelings of others, at the detriment to those that defend this nation. The terrorists know they are winning the most important battle, the propaganda one. Our civilian leaders and the morons in the Justice Department continue to bend over and spread 'em for the people that are beheading us, strapping explosives to themselves and lighting them off in a crowded market place, and striving through death and destruction to get closer to God.
And the men and women who are charged with keeping us safe now face greater danger and be more restricted in how they conduct the battle.
I know my solution to this problem is that I will emphasize the "kill" portion of the "kill or capture" portion of the Mission paragraph of the OP-ORDER. We will just zip up the bags and call the meat wagon.
The worlwide apology tour, the deep bow at the waist attempts at appeasing the Muslim world, and now this shift in policy only solidify the fact that Barack Obama ia a clear and present danger to the security of this nation.
