A pastor has been sentenced to jail after being convicted of breaking an Oakland law that creates a buffer zone between anti-abortion protesters and abortion clinics. The Rev. Walter Hoye was sentenced Thursday to 30 days in jail and ordered to stay 100 yards away from a clinic where he was arrested last May….
Massachusetts has a similar law. Much like the California version, both violate the First Amendment of the United States Constitution. People are allowed to protest all sorts businesses and organizations. Unless, of course, they are abortionists. If so, they get a special protective "right." Because the Government is regulating what you are protesting, they are regulating the message. This violates our Constitutionally protected Freedom of Speech.
It will be interesting to see how this case turns out. I predict it will prove to be an important one.
